Maxwell Minds™ Terms and Conditions

1. About these terms

These terms govern your use of Maxwell Minds™ services and the Maxwell Minds™ website. By booking or accessing any service, you agree to these terms in full.

Maxwell Minds™ is operated by Penny Maxwell, specialist pharmacist and founder of Maxwell Minds™. ABN: 12 727 579 959

2. Who Maxwell Minds™ services are for

Maxwell Minds™ services are available to clinicians, prescribers, patients, carers, and others seeking specialist expertise in medication management, neurodivergence, and complex mental health.

There is no restriction on who may book. However, by booking you confirm that your intended use falls within the scope described in these terms, and specifically within the restrictions set out in Section 4.

3. What Maxwell Minds™ provides

Maxwell Minds™ provides specialist advice, consultation, education, and coaching drawing on the expertise and frameworks developed by Penny Maxwell over 20 years of frontline clinical practice.

Services include but are not limited to:

  • Minds Brainstorm consultations
  • Clinical Consultations with written notes
  • Written enquiries and reports
  • MEDWISE™ reviews
  • Legacy Review™ and Medication Portrait™
  • Coaching for individual clinicians and organisations
  • Small group sessions

Advice is provided in good faith and is reliant on the accuracy of information provided by the person making the enquiry. Maxwell Minds™ is not liable for outcomes arising from inaccurate or incomplete information provided at the time of enquiry.

At no time does Maxwell Minds™ assume clinical responsibility for any patient. Final clinical decisions remain with the treating clinician and patient.

4. Intellectual property – this is important

All content, frameworks, methodologies, clinical approaches, tools, and materials created and used by Maxwell Minds™ – including but not limited to the MEDWISE™ review, Medication Portrait™, Legacy Review™, and MINDS Framework™ – are the intellectual property of Penelope Maxwell. All rights are reserved.

By accessing any Maxwell Minds™ service, you agree that you will not, without prior written agreement with Maxwell Minds™:

  • Reproduce, copy, adapt, or distribute any Maxwell Minds™ framework, methodology, tool, or session content in any form
  • Apply any Maxwell Minds™ framework or methodology in the development of any commercial product, service, training program, or organisational system
  • Use content from any Maxwell Minds™ session in any government contract proposal, funding application, or service design process
  • Use content from any Maxwell Minds™ session to design, develop, or deliver a service that competes with Maxwell Minds™
  • Share, teach, or on-sell Maxwell Minds™ content or methodology to any third party

Attendance at any session, payment of any fee, and receipt of any written output does not confer any licence, right, or permission to use Maxwell Minds™ intellectual property beyond your own personal or direct clinical use.

5. Confidentiality of session content

5a. Small group sessions

Content shared in small group sessions – including clinical frameworks, case discussion, regulatory navigation, prescribing approaches, and any materials provided – is confidential to the individual attendees and is provided for personal professional development only. It may not be recorded, reproduced, shared externally, or applied in any organisational, commercial, or policy context without prior written agreement with Maxwell Minds™.

5b. Individual consultations and clinical enquiries

When a clinician brings a patient case or clinical question to Maxwell Minds™, the consultation – including Penny Maxwell’s reasoning, clinical navigation, recommendations, and written outputs – is confidential to that clinician–patient relationship. It is provided to support your direct clinical decision making only.

Consultation content may not be:

  • Referenced, reproduced, or applied in service design or development
  • Used in any organisational reporting, proposal, or funding application
  • Used as a template, framework, or evidence base for building any clinical service or program
  • Shared with colleagues, managers, or organisations beyond the treating clinician without the express written consent of Maxwell Minds™

This applies whether the consultation is paid or complimentary, verbal or written, formal or informal.

6. Misrepresentation

If a client misrepresents their identity, professional role, or intended use at the time of booking or during any service, Maxwell Minds™ reserves the right to:

  • Except as otherwise provided by law, terminate the service immediately without refund
  • Pursue recovery of any losses arising from that misrepresentation
  • Take such further action as may be appropriate at law

7. Disclaimer and liability

Advice and outputs provided by Maxwell Minds™ are specialist in nature but are general to the question asked. They are not a substitute for full clinical assessment, and Maxwell Minds™ accepts no responsibility for clinical outcomes.

To the extent permitted by law, Maxwell Minds™ will not be liable for any loss or damage, whether direct, indirect, consequential, or economic, arising from use of any Maxwell Minds™ service or website.

You may have rights under the Australian Consumer Law in the form of consumer guarantees. In the event of a breach of such guarantees, Maxwell Minds™ limits its liability to the resupply of its services or the cost to you of having the services resupplied.

Advice is believed to be accurate and current as at the date provided. It is reliant on the accuracy of information provided by the person making the enquiry.

8. Privacy

Maxwell Minds™ handles your personal information in accordance with the 13 Australian Privacy Principles under the Privacy Act 1988 (Cth) and in accordance with the applicable provisions of the Health Records and Information Privacy Act 2002 (NSW). 9. Website

By accessing the Maxwell Minds™ website you agree to these terms. The website may use cookies to improve your experience. Log data including IP address, browser type, and pages visited may be collected automatically. This information is used only to improve the site and is not shared with third parties.

10. Changes to these terms

Maxwell Minds™ reserves the right to update these terms at any time. You will be given appropriate notice of any change, and the updated terms will be posted on the website. If you do not agree to the updated terms, you may terminate our services and you will be refunded any advance payment for services not received. Continued use of any service following an update constitutes acceptance of the revised terms.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
